SMS Messaging Terms & Compliance

1. Program Description

This messaging program sends ticket confirmations, booking confirmations, birthday party reminders, event updates, membership notifications, promotional offers, customer support communications, and other notifications to customers who interact with Funtastic Depot through our website at funtasticdepotbirthday.com, waiver forms, event registrations, ticket purchases, memberships, and online forms and who have expressly opted in to receive SMS communications.

Opt-in is collected through online forms, ticket purchases, waiver submissions, event registrations, membership sign-ups, and other customer interaction points that include SMS consent.

 

2. Cancellation Instructions

You can cancel the SMS service at any time. Simply text "STOP" to the same number that sent you messages. Upon sending "STOP," we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.

4. Carrier Liability

Carriers are not liable for delayed or undelivered messages.

Message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies based on your purchases, reservations, memberships, event participation, and interactions with our services.

 

6. Supported Carriers

Our SMS program works with all major U.S. wireless carriers, including AT&T, T-Mobile, Verizon, and most regional carriers.

7. Age Restriction

You must be 18 years of age or older to participate in our SMS program or have the consent of a parent or legal guardian.

Participant Agreement, Waiver, Release And Assumption Of Risk

Participation in Funtastic Depot attractions, inflatable attractions, playgrounds, climbing activities, arcade games, birthday parties, Glow Nights events, special events, and related activities involves inherent risks that may result in physical injury, emotional injury, paralysis, death, property damage, or other losses.
 

These risks include, but are not limited to, slipping, falling, improper landings, collisions with equipment, structures, staff members, or other participants, and other risks associated with active recreational activities.

Notice To The Minor Child'S Natural Guardian

By agreeing to these terms, you permit your minor child to participate in potentially dangerous recreational activities. Even when reasonable precautions are taken, serious injury or death may occur.

You understand and acknowledge that certain risks are inherent and cannot be eliminated without fundamentally altering the nature of the activities.

You have the right to refuse to sign this agreement; however, Funtastic Depot reserves the right to deny participation to any individual who does not agree to these terms.

Participation Agreement

On behalf of yourself, your spouse, children, family members, guests, and any individuals under your supervision:

 •You agree to use all attractions safely and responsibly

 • You acknowledge that certain events may include lighting effects, flashing lights, fog, smoke effects, music, and other sensory elements

 • You agree not to participate if you have any medical condition that may be aggravated by physical activity or event effects

 • You agree to follow all posted rules, safety guidelines, and staff instructions

 • You understand that failure to comply with park rules may result in removal without refund

 • You agree to immediately report any injury, unsafe condition, or incident to staff

Assumption of Risk

You voluntarily choose to participate and fully assume all risks associated with participation. You represent that:

 • You are physically capable of participating
 • You have no medical condition that would make participation unsafe
 • You are not under the influence of drugs or alcohol

 • You understand and accept all known and unknown risks associated with participation

Waiver and Release Of Liability

To the fullest extent permitted by law, you release, waive, discharge, and covenant not to sue Funtastic Depot, its owners, affiliates, officers, directors, employees, contractors, agents, successors, and assigns from any and all claims, demands, damages, liabilities, losses, costs, or expenses arising from:

 • Participation in activities
 • Use of facilities and equipment

 • Actions of other participants

 • Presence on the premises

 • Any alleged negligence

This waiver applies to all claims, whether known or unknown, now existing or arising in the future.

Indemnification

You agree to indemnify, defend, and hold harmless Funtastic Depot from any claims, liabilities, damages, costs, expenses, or attorney's fees arising from your participation, conduct, or violation of these Terms.

Media Release

You grant Funtastic Depot permission to photograph, record, videotape, and otherwise capture your image, likeness, voice, and participation.

You authorize Funtastic Depot to use these materials for advertising, promotional, marketing, social media, and business purposes without compensation.

Parent or Guardian Consent

If signing on behalf of a minor participant, you certify that you are the parent or legal guardian or have been authorized by the legal guardian to act on the minor's behalf.

You acknowledge that all waivers, releases, assumptions of risk, and indemnification obligations contained in these Terms apply equally to the minor participant.

Disclaimers

The information, products, and services provided through the Site are provided "as is" without warranties of any kind, either express or implied.

To the fullest extent permitted by law, Funtastic Depot disclaims all warranties, including warranties of merchantability and fitness for a particular purpose.
